Commercial Legal and Business Development Director

Duties:  Lead negotiation of contracts with partners/developers/operators on complex turnkey and infrastructure pursuits to optimize Alstom's commercial position; lead commercial negotiations with customers on all commercial contracts for the projects Alstom pursues, in accordance with internal legal procedures, processes, and governance requirements; maintain thorough knowledge of company products, systems, engineering services and new developments especially from a contract perspective; analyze competition and position Alstom appropriately on teams to pursue infrastructure opportunities, after having secured all necessary legal and commercial internal approvals; monitor trends that indicate the need for new products and services and report on the same internally to Systems and Infrastructure Division at Headquarters to support product and market developments in light of competitors' activities, developments and market trends in rail infrastructure projects; plan, direct, and coordinate business development activities in the Systems and Infrastructure division, in light of prevailing market environment and with a view to winning new business contracts; leverage deep knowledge of rail stakeholders in NAM, particularly those with Developers, Contractors, Financiers, Operators in Infrastructure and Public Private Partnership (P3) project environment to develop sustainable business opportunities that will ensure achievement of all NAM S&I sales objectives or new business contracts; keep abreast of competitive market and infrastructure project activity in order to identify appropriate pursuits for Alstom; and on given pursuits, develop cost and mark-up factors, and pricing strategies with the goal of winning the project in question and maximizing the firm's profits while ensuring customer satisfaction.   Requirements: Employer will accept Bachelor's degree in Business, Business Law, Law, or related field, followed by five years of progressive, post-baccalaureate work experience in job offered or five years of progressive, post-baccalaureate work experience in a related occupation. Experience must include five years of experience with each of the following: experience with contact negotiations throughout Canada; related commercial and legal experience in complex projects in the rail industry; experience with projects in the rail sector in the various provinces of Canada; experience leading commercial negotiations on rail projects including rail P3 in North America, involving rolling stock, infrastructure, signaling, operations and maintenance; experience with commercial negotiations on projects with contracts with a value in excess of USD 500M; experience with business development in the rail sector, including the development of pricing strategies; and experienceworking with rail industry stakeholders (consultants, local agencies, regulatory agencies, unions, engineering firms, O&M providers, civil companies, financiers).  Must be available to work on projects at various, unanticipated sites throughout the United States. Must be available to travelinternationally up to 15% of the time. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
